Aaron Halegua Examines Impact of Section 1981 Ruling

Aaron Halegua (’09), Partner at Aaron Halegua, PLLC, was quoted in Bloomberg Law News discussing a recent Ninth Circuit Court of Appeals decision affirming standing for U.S. citizens in bias claims on the basis of citizenship under Section 1981 of the 1866 Civil Rights Act (“Meta Ruling Gives US Citizens Path to Sue for Alleged H-1B Abuse,” Jul. 2). Aaron pointed to a “ripple effect” of the ruling and a likely increase in the volume of litigation. “You’d have a private right of action as opposed to just going to the DOJ and asking them to investigate and go through the administrative process,” he said. “If upheld, it will be a large shift.”
